Prices quoted in Price Lists are subject to change without notice. The price charged will be that ruling on the day of order unless otherwise agreed in writing, and will be subject to value added tax and any other government duty or tax applicable. - PAYMENT TERMS
Strictly – 30 days from end of month of invoice unless otherwise stated. - FORCE MAJEURE
The seller shall be relieved of the performance of its obligations for the duration and to the extent that it is prevented in the performance of its obligations by reasons of force majeure. For purposes of this clause force majeure is defined as circumstances or events which have not been foreseen at the time of the seller and which prevent the performance of contractual obligations hereunder and which are not capable of being remedied. Acts of God, acts of war, acts of Government, blockades, revolutions and industrial disputes may constitute force majeure if the elements thereof as defined in this clause exist. - RETENTION OF TITLE AND PASSING OF PROPERTY
a) The ownership of all goods supplied and under each contract between the seller and the buyer shall remain with the seller until such goods have been paid for in full.
b) Such retention of title shall not be deemed to constitute an Agency or imply that the buyer in any way acts as an Agent in respect of the products supplied by the seller.
c) In the absence of written advice from the buyer to the carrier and seller described in clause 5 below, the goods shall be deemed to have been delivered and accepted by the buyer complete and in satisfactory condition.
d) The buyer hereby authorises the seller to enter any premises of the buyer for the purpose of repossessing the products. - NOTIFICATION OF LOSS OF, DAMAGE TO, OR NONDELIVERY OF, GOODS OR PACKAGES:
Claims for goods lost or damaged in transit will not be entertained unless notice is given in writing of non delivery or damage within 7 days of despatch. The carrier should be notified immediately. - RETURNS POLICY:
Under no circumstances will goods be accepted for return/ credit where any of the following applies:
a) Where the goods are returned without prior authorisation in writing from the company.
b) Goods which are deemed to be in an un-saleable condition.
c) Goods which are not in original sales units or have broken seals.
d) Goods which have not been stored in accordance with manufacturer’s instructions.
e) Goods which have passed their sell by date.
f) Vaccines cannot be returned under any circumstances
Goods may be returned following prior written notification by Agrihealth in the following circumstances.
a) Where the product has been deemed faulty or damaged on arrival.
b) In the case of equipment, where goods are returned under warranty for repair or replacement. However, a credit will not be issued.
c) Where the wrong product has been dispatched in error.
The seller reserves the right to recover any/all charges associated with the disposal of the goods returned. - WARRANTY
Warranty on animal health equipment provides for free repair of faults, due to faulty workmanship or materials, which occur through normal use of the item in the purpose for which it is intended in the 12 months from the endusers date of purchase. Date of purchase must be proven by the buyer in each and every case. - ASSIGNABILITY
This contract is personal to the parties hereto and shall not be assigned to any third party of either the buyer or the seller without the other party’s written consent. - LAW
This contract is deemed to be made in both Northern Ireland and Republic of Ireland under the regulations governing both areas and is governed in all respects by the authorities in both jurisdictions.
Agri tags T & Cs Free Replacements for the life of the animal;
- Proof of purchase must be provided at time of claim.
- Postage costs on Free replacement tags covered by the claimant.
- Proof of accurate tag placement may be required if multiple claims are submitted.
